Appeal from a judgment of the Supreme Court (Dier, J.), entered April 23, 1990 in Essex County, which, inter alia, dismissed petitioner’s application, in a pro*913ceeding pursuant to CPLR article 78, to compel respondent Town Board of the Town of Ticonderoga to remove the Town’s Chief of Police.
