— Reversing.

Appellant, Hugh Meredith, shot and killed Andrew Saylor. He was tried and convicted of voluntary manslaughter, and given an indeterminate sentence in the penitentiary of from two to twenty-one years.

The homicide occurred under the following circumstances: On the last Sunday in September, 1911, the ‘“Association,” a religious organization, wa:s conducting services at a church on Red Bird Creek, in Bell •County, Ivy.
