This case is before us on the exception of the appellant, R. W. Evans, to the decision of a justice of the superior court affirming, bn appeal, a decree of the probate court of the city of Newport.
The appellant, who was then a resident of the state of New York,' but afterwards became a resident of Canada, filed a petition in the probate court of the city of Newport in this state, praying that he be appointed administrator, c.t.a, of the estate in Rhode Island of Mary B.
