This is an appeal from a decree of the district court of Tulsa county determining the heirs of Charles Mashunkashey, a deceased Osage Indian. The appellant is Margaret Mashunkashey, surviving wife of the deceased, who will be referred to as defendant.

-The proceeding originated in the county court. Ben Mashunkashey, a half brother of the deceased, filed a petition in the administration proceedings to determine the heirs of deceased alleging that he was the sole heir.
