JOHNSON, J.

This case is before us on remand from our Supreme Court. We were directed to reconsider it in light of footnote 2 in People v. Craft (1986) 41 Cal.3d 554, 559 [224 Cal.Rptr. 626, 715 P.2d 585].

Appellant Daniel O. Galvan was charged by information in count I with kidnapping in violation of Penal Code section 207. In counts II and III, appellant was charged with rape in violation of section 261, subdivision (2).
