Jacob Berreski, a minor, while crossing Bainbridge street, in Philadelphia, was struck and injured by an automobile owned by the defendant .company and operated by its employee. This action was subsequently brought to recover for the injuries he was alleged to have sustained. The first trial in the court below resulted in a verdict and judgment in favor of the defendant, which judgment was reversed because of an error in the instruction to jury; Berreski v.
