Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating a prison disciplinary rule.

Petitioner became agitated after a correction officer informed him that he was getting a roommate. He then refused the officer’s directives, used profanity toward the officer and threatened to kill the officer when he was released from prison.
