Actions sounding in tort were brought by Claimants against the State of Illinois pursuant to section 8(d) of the Court of Claims Act (Ill. Rev. Stat. 1990, ch. 37, par. 439.8(d).) The claims were consolidated for purposes of this review, as they both arose out of the same occurrence.

At the time of the accident, Claimant, Kevin R. Phillips, was driving an automobile east on Illinois Route 104, a two-lane highway approximately 1/2 miles east of the town of Liberty, Illinois. Also in the automobile was Mr. Phillips’ wife, Claimant Tracy L. Phillips, the front seat passenger,…
