This is an appeal from a judgment dismissing a suit for the appointment of a receiver of a corporation. The petition for the order of appeal was filed long after the expiration of 10 days from the signing of the judgment dismissing the suit and refusing to appoint a receiver. The defendant corporation has moved to dismiss the appeal because it was not “taken and perfected within ten days from the entry of the order * * * refusing to appoint a receiver,” as required by Section 4 of Act 159 of 1898.
