OPINION RE: CENDANT MORTGAGE CORPORATION’S NOVEMBER 5, 2010 MOTION — STAY

Cendant Mortgage Corporation (“Cen-dant”) seeks relief from the automatic stay because of Debtors’ post-confirmation defaults on a long term indebtedness secured by their residence. The motion is granted.

BACKGROUND 1

Debtors confirmed their plan on June 23, 2007. Among other things, the plan permits Debtors to retain their home notwithstanding Cendant’s mortgage and the debt it secures. Cendant had lent $112,000.00 to Debtors in 2001 with the understanding that they would repay the loan…
