Mrs. Clara Sue Padgett,2 widow of World War II veteran Barney O. Padgett, applies through counsel pursuant to the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412(d) (2009), for an award of attorney fees and expenses in the amount of $87,802.17 for 565.2 hours of attorney work and $650.23 in expenses. The Secretary challenges (1) whether Mrs. Padgett is a prevailing party; (2) whether the position of the Secretary was not substantially justified; and (3) whether the amount of fees and expenses requested are reasonable.
