The plaintiff, Pamela Sestito, as administratrix of the estate of Dominick Sestito (hereinafter decedent), brought this action against the city and the town of Croton 1 (hereinafter town) and Edward H. Fontaine, a policeman employed by the town, to recover damages for her decedent’s death during an alleged public disturbance at which the defendant Fontaine was a patrolling officer.
