This matter is before the Court on cross motions for summary judgment filed by plaintiff Taft Broadcasting Company (doc. no. 13) and defendant United States of America (doc. no. 14), upon memoranda in support of and in opposition to such motions (doc. nos. 15,17) and upon the parties’ stipulation of facts (doc. no. 11). Plaintiff seeks a refund of federal income taxes paid for the tax period beginning April 1, 1972 and ending March 31, 1973 (the 1973 Tax Year).
