Florida Parole and Probation Commission moves to dismiss this appeal on the grounds that the notice of appeal was not timely filed.

*821On December 3, 1981, the Commission entered its final order establishing appellant’s presumptive parole release date. In accordance with Daniels v. Florida Parole and Probation Commission, 401 So.2d 1351 (Fla. 1 DCA 1981), appellant timely filed a notice of appeal on December 28,1981.
