The first point, made by the appellant, is that, where the board of local improvements proceeds upon a petition of property owners, its action must be based upon the petition of the owners of at least one-half of the property fronting upon the proposed improvement; and it is alleged, that, in the present case, the total number of signatures, affixed to the petition for the improvement, represent less than one-half of the total frontage of the property upon the improvement.
