The School Board of the Pardeeville Area School District appeals an order awarding attorney fees to a former high school principal, Cynthia Bomber, under § 895.46(1), Stats.1 *400Bomber cross-appeals the amount of attorney fees awarded, which was less than the amount she claimed due her. Because we conclude that the Board did not sue Bomber either in her official capacity or as an individual because of acts committed while carrying out her duties as a school principal, we conclude that § 895.46(1) does not apply to this action. Therefore, we reverse the order awarding attorney fees to Bomber.
