Appeal from an order of the Supreme Court (McDermott, J.), entered January 9, 1990 in Albany County, which, inter alia, granted the motions of defendants Mintzer Petroleum Corporation and Hanover Insurance Company to dismiss the cross claims against them for lack of jurisdiction and failure to state a cause of action.
