DUFRESNE, Justice.
On November 10, 1964, the plaintiff brought the instant action for breach of contract in which real estate in the name of the defendant was attached. Defendant asserts as one of his defenses the following: “A prior suit for the same cause of action, between the same parties was commenced in March, 1964, in the Middlesex County, Connecticut Court of Common Pleas and said suit is still pending.
