(dissenting).—I am unable to concur, and file some of the reasons for my dissent.
Appellant was convicted of manslaughter and allotted the maximum punishment in the penitentiary for that offense.
A brief statement of the facts show that appellant and deceased, George Highfill, had been partners in the butcher business. Owing to trouble arising between them, appellant had bought the interest of Highfill and continued the business.
