Lindley and Sherman Madden, under Rule 56, Federal Rules of Civil Procedure, 28 U.S.C.A., in which it alleged that the pleadings filed herein and the Response to Demand for Admission of Facts filed by said defendants, together with certified, photostatic copy of Articles of Incorporation of Ozark Poultry & Egg, Inc., show there is no genuine issue as to any material fact herein and that plaintiff is entitled to judgment against said defendants.
