MEMORANDUM OPINION AND ORDER OF DISMISSAL

HANSEN, District Judge.

THIS MATTER comes before the Court on motions of the Defendants and Interve-nors (“Defendants”) for dismissal or alternatively, for summary judgment (Docket Nos. 62 and 71). 1 Plaintiffs have raised the issue as to the propriety of a summary judgment motion in this matter.
