Petitioner in this CPLR article 78 proceeding seeks to annul the determination of respondent which denied petitioner’s application for residential health care assistance.

In July, 1979, petitioner entered into residence at the Mary Manning Walsh Home. In October, 1979, petitioner applied to the New York City Department of Social Services for health care assistance.
