This matter is almost identical in its most salient features with those presented in the case of the People on the relation of Rollins v. The Board of County Commissioners of Rio Grande County, 7 Colo. App. 229, decided at the December term of this court. Rollins brought suit against Grand county in 1890, in the district court of Arapahoe county, and recovered judgment for $9,947.87 and costs. He afterwards transferred the judgment to the New Hampshire Savings Bank, which filed the petition in mandamus.
