This is a proceeding to contest an election held in Chase county on November 16, 1886, for the voting of county bonds to be used in paying for stock of the Chicago, *95Kansas & Western Railroad Company, and in aid of the construction of the railroad of that company in Chase county. It was brought by D. C. Evans, an elector of the county, against the board of county commissioners and the county clerk of Chase county, under the provisions of chapter 79 of the Laws of 1871.
