In this action the appellees, as plaintiffs, sued ■ the appellant, as defendant, before a justice of the peace • of Marion county, Indiana.

*283In their complaint, the appellees alleged, in substance, that they were, and bad been for more than one year, partners in business under the firm name of ÍT.
