In an action, inter alia, to recover damages for negligence and negligent entrustment, the defendant Mt. Kisco Chevrolet Cadillac, Inc., appeals, as limited by its brief, from so much of an order of the Supreme Court, Westchester County (Colabella, J.), *665entered June 30, 2008, as denied that branch of its motion which was pursuant to CPLR 3211 (a) (7) to dismiss the second cause of action for failure to state a cause of action.
Ordered that the order is reversed insofar as appealed from, on the law, with costs, that branch of the motion of the defendant Mt. Kisco Chevrolet Cadillac, Inc., which…
