The first question to be determined is whether or not the contract which it is sought to have enforced was proved.
*583* Vincent Bockecharlie, the father of the complainant, was a member of the Knights of Honor, and as such member held a benefit certificate of the order for §2,000, payable at his death to his wife, Martha Catherine Bockecharlie and their children, one of whom was the plaintiff, W. P. Bockecharlie.
Martha Catherine Bockecharlie died in 1879, and Vincent Bockecharlie married again in 1882.
