Drake and others presented to the judge of the superior court of the Flint circuit a petition setting out the following facts: Petitioners are citizens, taxpayers, and registered voters of Spalding county. On the 19th day of October, 1899, an election was held in said county under the local option law. At the election a majority of the votes was cast in favor of the sale, and the managers of the election made returns to the ordinary, and it was the duty of that officer to immediately consolidate the vote and declare the result-of the election.
