SUMMERS, Justice:
The case turns on whether the Plaintiffs, parents of a deceased child, may proceed with their suit against the School District in the District Court. The trial court, and the Court of Appeals, took the position that the parents’ failure to have themselves appointed as personal representatives of their daughter’s estate until after the running of the statute of limitations was fatal to their claim, even though the parents had otherwise timely brought the suit.
