MEMORANDUM OPINION AND ORDER

JOINER, District Judge.

This is a no-fault insurance case. Plaintiffs are the widow and children of the decedent, Dr. Juan E. Olivera. Defendant is a corporation which was incorporated under the laws of the State of Illinois, maintains its principal place of business in the State of Illinois, and is in the business of insuring motor vehicles. Two issues are presented by the parties at this time through their respective motions for summary judgment.
