This was an action by the appellee, as plaintiff, against the appellant, as defendant, in the court below, to recover the value of certain personal property, described in a bill of particulars filed with the complaint, alleged to have been sold and delivered by the appellee, to the appellant.

To appellee’s complaint, the appellant answered in three paragraphs, as follows:

1st. A general denial;

2d. Payment in full; and,

3d. Eor a further answer to that portion of appellee’s complaint, which sought to recover judgment for the oats and corn, mentioned in the bill of particulars filed with said…
