GRAVES, Judge.

Appellant was convicted by a jury for keeping a room and place for the purpose of being used as a place to bet and wager, and to gamble with dice, and he was awarded a penalty of two years in the penitentiary.

The facts show that the officers looked through the windows of a house controlled and occupied by appellant and saw a dice game in progress. They broke into the house and some one extinguished all the lights.
