OPINION
{¶ 1} Plaintiff-appellant, the state of Ohio, appeals the decision of the Clermont County Court of Common Pleas granting a motion to dismiss in favor of defendant-appellee, Diane Collins. For the reasons stated below, we affirm the decision of the trial court.
{¶ 2} The facts of this case involve a high-speed chase between appellee and police officers in Clermont and Hamilton Counties. On October 25, 2002, Glen Cain committed a theft offense at a Kroger store in Milford. Appellee served as the driver of the getaway car.
