The defendant, a licensed dram-shop keeper, was indicted under section 4590 of the Revised Statutes, for selling intoxicating liquor in his dramshop on Sunday. He was convicted, sentenced to pay a fine of $50, and prosecutes this appeal to this court. So much of the statute as is material is as follows: “Any person having a license as a dramshop *573keeper, who shall keep open snch dramshop, or shall sell, give away, or otherwise dispose of, or suffer the same to be done upon or about his premises, any intoxeating liquors in any quantity, on the first day of the week, commonly called Sunday, * *…
