OPINION

BUSSEY, Presiding Judge:

Appellant, James Sherman Bunn, hereinafter referred to as defendant, was charged, tried and convicted in the Oklahoma County District Court, Case No. CRF-74—4387, for the crime of Operating a Motor Vehicle While Under the Influence of Intoxicating Liquor, second and subsequent offense, in violation of 47 O.S.1971, § 11-902. Trial was had to a jury and punishment was fixed at two and one-half (2⅛) years’ imprisonment in the State penitentiary, and a fine of Five Hundred ($500.00) Dollars. From this judgment and sentence defendant has perfected his timely appeal.
