Defendant appeals from judgment entered after a jury verdict of guilty of second-degree murder. We determine the trial court committed prejudicial error and remand for a new trial.

FACTS

On 18 February 2005, Manee Hargrove Battle drove a Grand Marquis with passengers Dwayne Parker, Antwone Parker, and Ledarius Banks (“defendant”) from Rocky Mount, North Carolina, to visit a dance club in Greenville, North Carolina.
