The only issue in this action involves the proper classification of sweetened molten chocolate imported by plaintiff from Canada. Plaintiff alleges that the merchandise should be classified under item 156.25, TSUS, as “Chocolate: ... Sweetened: In bars or blocks weighing 10 pounds or more each ... ”, and contests the classification by Customs under item 156.30 as “Chocolate: ... Sweetened: ...
