OPINION

MEROW, Judge.

This military pay case is before the court on cross motions for summary judgment. Plaintiff contests the action of the United States Army Finance and Accounting Center (the “Army” or “AFAC”) in terminating her *832Survivor Benefit Plan (“SBP”)1 payments, on the asserted basis that she is not the surviving spouse beneficiary, as required by law, to receive the benefits.
