This case comes before us on appeal by the defendants, Michael Annarummo, 1 in his capacity as director of the Department of Environmental Management of the State of Rhode Island (the director), and the Department of Environmental Management of the State of Rhode Island (DEM), from a Superior Court judgment entered in favor of the plaintiffs, Newbay Corporation, Rhode Island Cogeneration Associates, and OEIG Limited Partnership, ordering the director and DEM to issue an air permit to the plaintiffs.
