LUMBARD, Circuit Judge:

Aaron Stewart appeals from a judgment of conviction entered on November 7, 1974, in the Southern District following a jury trial at which he was found guilty of one count of bank robbery, 18 U.S.C. § 2113(a), one count of assault during the commission of a bank robbery, 18 U.S.C. § 2113(d), and one count of conspiracy, 18 U.S.C. § 371, to violate 18 U.S.C. § 2113. Stewart was sentenced to concurrent terms of ten years in prison on the two substantive counts and five years in prison on the conspiracy count.
