This is a suit to rescind sale of goods, land for their value, brought December 9, 1897, by appellee against the First National Bank of Nacogdoches, R. A. Hall, J. H. Cox, and S. Kaplan & Bro., a firm composed of S. Kaplan and Harry Kaplan, upon the ground that Hall, a merchant of Nacogdoches, bought the goods on the 13th of August, 1897, of plaintiff, of the value of $1493.44, in St. Louis, Ho., on credit, with the intention not to pay for them, and, as a basis of such credit, made a false statement in writing as to his assets and liabilities at the time of the…
