The defendant was indicted for murder, found guilty as charged, and sentenced to death. He has appealed, and relies for reversal on a number of bills of exception.
1.Defendant filed a general demurrer to the indictment, which was overruled, and thereupon he excepted in due form. The indictment charges that one James Raymond Hogan, late of the parish of Orleans, on the ■15th day of November, 1905, with force and arms, in the parish of Orleans, aforesaid, and within the jurisdiction of the criminal district court, “feloniously, willfully, and of his malice aforethought did kill and murder one…
