GARDNER, Chief Justice.

In the final analysis this suit is by the Birmingham Electric 'Company against Porter Scott, resulting in a judgment for the sum of $3500, from which judgment •defendant Scott appeals.

That defendant Scott in April, 1945, ran the stop signal at 6th Avenue and 14th •Street in the city of Birmingham, Alabama, and seriously damaged plaintiff’s automobile, driven by its servant or agent E.
