This case was disposed of in the trial court upon the following agreed statement of facts:
“(1) That on or about the 1st day of December, A. D. 1915, plaintiff and defendant, both being citizens of Texas and of the United States, entered into a contract by the terms of which defendant rented and leased to plaintiff for a period of one year, beginning on the 1st day of January, 1916, and ending on the 31st day of December, 1916, 15 acres of black prairie land, all of which was in cultivation and belonging to defendant, located about four miles from the town of Creedmoor, in Travis county,…
