This action came on for trial before the court and a jury and resulted in a verdict in favor *351of the plaintiff for the sum of $1,000. On the rendition of said verdict the defendant moved to set the same aside upon all the grounds stated in section 999 of the Code of Civil Procedure, which motion was entertained by the court.
It appears from the facts herein that on the 15th day of August, 1914, the defendant employed and engaged the plaintiff to procure a responsible person who would become a partner in his business of manufacturing cloaks and suits; that thereafter during the course of said…
