*452Plaintiff-Appellee James K. Whittington brought this lawsuit against four Concordia Parish employees, including Defendant-Appellant Randy J. Maxwell, Sheriff of Concordia Parish, asserting claims under 42 U.S.C. § 1988 for malicious prosecution in violation of his Fourth Amendment rights and retaliation in violation of his First Amendment rights, as well as a state law claim for malicious prosecution.
