On June 11, 1934, one Anthony Broski operated a grocery store and meat market in the village of Somers in Kenosha county, At about 9:25 p. m. on that *392day both he and his wife were in the store. They were about to close it up for the night. Mr. Broski was behind the meat-service counter, which was located at the rear of the store. At about that time a man walked into the store and asked for a package of Chesterfield cigarettes. Mrs. Broski procured the requested cigarettes for him and was paid the price thereof.
