LATTIMORE, Judge.

Conviction for assault with intent to murder, punishment five years in the penitentiary.

Appellant was convicted for an assault with intent to murder Mary Ransom. The testimony for the state shows that following a protracted gambling spree engaged in by appellant and others, and in which appellant lost all of his money to Mary Ransom, he went to her house, where she was alone, after midnight and attempted to effect an entrance.
