Quo zvarranto proceedings were instituted in the circuit court of Cook county to test the constitutionality of the Chicago Park District act and to test the regularity of the election by which it was adopted. The action sought to oust the appellees, Robert J. Dunham, Harry Joseph, Martin H. Kennelly, B. C. O’Neill and John R. Nash, who had been appointed commissioners of the Chicago Park District by appellee Edward J. Kelly, mayor of Chicago, acting under authority conferred upon him by the act.
