This appeal was brought by plaintiff/appellant, The Cadle Company (hereinafter “Ca-dle”), from a final judgment order of the Circuit Court of Randolph County, which found that the defendant/appellee, Citizens National Bank (hereinafter “CNB”), was not obligated to turn over the proceeds of a $10,000.00 Certificate of Deposit to Cadle. The case was tried before the circuit court without a jury. In this appeal Cadle contends that the circuit court committed error in finding that it was not entitled to the proceeds of the CD. We disagree and affirm.
